General Terms and Conditions of Rotho Kunststoff GMBH

1. Validity

Our deliveries are made exclusively on the basis of these General Terms and Conditions (GTC). These General Terms and Conditions apply to the processing of all orders placed with Rotho Kunststoff GMBH via the Internet. At the latest when our goods are accepted, these General Terms and Conditions are deemed to have been accepted by the customer.
Our online product offers are only valid while they are visible on the website and while stocks last. The images shown on the website are for illustration only and are not binding.

2. Formation of the contract

Our website is not an offer in the legal sense, but an invitation to an offer. With the final confirmation of your order, you make us a binding offer to conclude a purchase contract. You will then immediately receive an e-mail from us about the receipt of your order. The acceptance of your order and thus the conclusion of the contract takes place through the delivery of an order confirmation with the track & trace number of your package when the shipment has taken place. In the case of prepayment, we confirm the conclusion of the contract by sending our account details.
All offers are non-binding. We are free not to accept an order for any reason and to refuse to confirm it. We reserve the right to change prices and assortment at any time. Deliveries are only made if the delivery and billing address is in Switzerland. There is no minimum order value.
If, after the order confirmation, it is determined that the delivery cannot be completed in full because individual products are not in stock at short notice, we will inform the customer in writing of a new delivery date.

3. Prices and shipping costs

All prices include the statutory turnover or value added tax.

Delivery is free from 45 EUR.*

Delivery under 45 EUR costs 3.95 EUR.

Cost of return:

1) Orders that were for more than 45 EUR - free return

2) Orders that were for less than EUR 45 - return shipping of EUR 3.95 will be deducted from the total.

*During promotions, shipping costs remain the same, but minimum order value for free delivery changes.

Black Week (23-30.11):

Delivery is free from 25 EUR.

4. Delivery time

All deliveries are made within 6 working days. If we do not have an item in stock, we will inform you immediately of a new delivery date.

5. Terms of payment

Payment is made at our discretion by prepayment, Paypal, invoice, credit card, Postfinance Postcard, e-finance or instant transfer. The invoice amount will be debited after delivery of the order confirmation with the Track & Trace number. We reserve the right to deliver goods exclusively against prepayment. When paying on account, you undertake to pay the invoice amount within 14 days of receipt of the goods. If you are in arrears with the payment, we reserve the right to charge a reminder fee. You can only exercise a right of retention if the claims stem from the same contractual relationship.
Payment by sending cash or checks is not possible. We exclude liability for any losses.

6. Retention of Title

The delivered goods remain our property until full payment. The customer is obliged to cooperate in measures that are necessary to protect our property. In particular, upon conclusion of the contract, the customer authorizes us to enter or register the retention of title in public registers, books or the like in accordance with the relevant national regulations and to fulfill all the relevant formalities at his expense.

7. Right of return and return policy

If you are a consumer, ie a natural person who makes the purchase for a purpose that cannot be attributed to your commercial or self-employed professional activity, you are entitled to the right of return described below. This does not apply to goods that have been specially made for you according to individual customer specifications.

You can return the goods received without giving a reason within 30 days by returning the goods. The period begins after receipt of this instruction in text form (e.g. as a letter, fax, e-mail), but not before receipt of the goods by the recipient (in the case of recurring deliveries of similar goods not before receipt of the first partial delivery) and also not before we have fulfilled our statutory information and other obligations. You can only declare the return of goods that cannot be sent as a parcel (e.g. bulky goods) by requesting their return in text form. To meet the deadline, the timely dispatch of the goods or the return request is sufficient. In any case, the return is at our expense and risk. The return request must be sent to:

In the case of an effective return, the services received by both parties are to be returned and, if necessary, any benefits drawn are to be surrendered. In the event of deterioration of the item and for uses (e.g. advantages of use) that cannot be handed over in part or only in a deteriorated condition, you must pay us compensation for the value. You only have to pay compensation for the deterioration of the item and for any use made if the use or deterioration is due to handling of the item that goes beyond the examination of the properties and functionality. "Checking the properties and functionality" means testing and trying out the respective goods, as is possible and customary in a retail store. Obligations to reimburse payments must be fulfilled within thirty days. The period begins for you with the dispatch of the goods or the return request, for us with the receipt.

8. Warranty and right of exchange

The statutory warranty regulations apply. In the event of defects in the delivery, please contact our customer service by email (rothoshop@rotho.com) immediately after you have identified them. Customer Service will send you a return label within two to three days. You can return the faulty goods to us free of charge. We replace faulty goods. Should this be impossible or unreasonable in individual cases, we will reimburse you for the purchase price already charged.
In the event of an incorrect delivery, please contact our customer service by e-mail (rothoshop@rotho.com) immediately after you have identified it. Customer Service will send you a return label within two to three days. You can send the incorrectly delivered goods back to us free of charge. The purchase price will be credited back after receipt of the goods.

9. Jurisdiction, Applicable Law, Severability Clause

If you are a merchant, trading company or legal entity under private or public law or a special fund under public law, the place of jurisdiction for all disputes arising from or in connection with the contractual relationship is the registered office of Rotho Kunststoff GmbH, although we are entitled to prosecute you at your place of residence or registered office or at any other place of jurisdiction granted by law. In the event of disputes arising from consumer or consumer contracts, you can bring an action at the domicile or registered office of one of the parties.
Substantive Swiss law applies to all legal relationships between us and the customer, excluding the United Nations Convention on Contracts for the International Sale of Goods (Vienna Sales Convention, CISG). If you are a consumer, the statutory regulations of the state in which you have your habitual residence also apply, which may not be deviated from by agreement.
Should individual provisions of these General Terms and Conditions be inadmissible, this does not affect the effectiveness of the remaining clauses.

10. Promotion

Summer promotion conditions:

For each order you can use a code for a 25% discount.

The promotion will take place from 22.06 to 02.07 2023.

The code is only valid for the entire range in this store.

The delivery time can be extended by up to 10 days.

 

Rotho is not liable for codes found on external sites.
